1. Agreement to Terms
By accessing our website or requesting services from EnviroMax Services, Inc. ("EnviroMax," "we," "us," "our"), you agree to be bound by these Terms of Service. If you do not agree, please do not use our website or services.
2. Services
EnviroMax provides water damage restoration, mitigation, structural drying, sewage cleanup, and related services in Southeast Michigan. Specific scope, pricing, and timelines for any project will be documented in a written work authorization prior to commencement of services.
3. Service Requests
Submitting a request through our website or by phone does not create a contract. A binding agreement exists only when a written work authorization is signed by both parties (or, in true emergencies, when verbal authorization is documented). We reserve the right to decline service for any lawful reason.
4. Payment & Insurance
You are responsible for full payment of services provided, regardless of insurance coverage. Where authorized, we will bill your insurance carrier directly, but you remain liable for any deductible, depreciation, or amounts not covered by your policy.
5. Property Access
You authorize EnviroMax personnel and authorized subcontractors to enter the service property to perform agreed-upon work, including the installation, monitoring, and removal of drying equipment.
6. Limitation of Liability
To the fullest extent permitted by law, EnviroMax's total liability for any claim arising out of services rendered shall not exceed the amount actually paid by you for the specific services giving rise to the claim. We are not liable for pre-existing conditions, hidden damage not reasonably discoverable, or consequential, incidental, or punitive damages.
7. Mold & Hidden Damage
Water damage may reveal pre-existing mold growth or structural issues that are not the result of the current loss. EnviroMax is not responsible for pre-existing conditions, and additional services may be required at additional cost.
8. Website Use
All content on this website — text, images, logos, and design — is owned by EnviroMax or its licensors and is protected by intellectual property law. You may not reproduce, distribute, or create derivative works without written permission.
9. Disclaimers
Our website and any informational content are provided "as is" without warranties of any kind. Response times are estimates and may vary based on weather, traffic, and crew availability.
10. Governing Law
These Terms are governed by the laws of the State of Michigan, without regard to its conflict of laws principles. Any disputes shall be resolved in the state or federal courts located in Macomb County, Michigan.
11. Changes to Terms
We may revise these Terms at any time. Continued use of our website or services after changes constitutes acceptance of the revised Terms.
